Families of 2 men who died, 1 who survived DUI crash accuse Dauphin County bar of ‘over serving’ them
Mulroy, Kijowski and Shovlin, all 24, died at the scene, while Wilk, then 25, suffered severe and permanent injury, according to the litigation.
Wilk and Shovlin arrived at PJ Whelihan’s around 3 p.m., with Kijowski and Mulroy joining them at 5 p.m. to watch football. The group left to go to another bar just after 8 p.m. Mulroy was served two drinks at the same time once during the outing, which the suits call a violation of “responsible alcohol standards.”
The families argued that Kijowski, Wilk and Shovlin were too intoxicated from being over-served to realize how bad it would be if Mulroy drove, and that the men did not think to arrange for different transportation. Attorneys believe Mulroy was driving 80 mph on Nyes Road, moments before turning on Jonestown Road where the speed limit is 25 mph.
