They hold the force of law but must align with the Constitution and existing federal statutes.

Issuing an executive order involves a series of steps outlined in Executive Order No. 11030, established by President John F. Kennedy in 1962. Drafts must be submitted to the Office of Management and Budget for review. If approved, it goes to the Attorney General, then to the Federal Registrar, and then back to the President to be signed.

The issue of border security has been a contentious one, particularly after most Senate Republicans, along with a few Democrats, blocked a comprehensive border security deal earlier this year. The deal, part of a $118 billion supplemental package also providing aid to Ukraine and Israel, faced significant opposition. The congressional inaction has raised questions about how much action the President can take without them.
