“Roger Ailes is gone,” said a Fox News insider, “but the people who enabled his actions are still very much there”
an accusation of sexual harassment. In October, McHenry filed a sexual harassment complaint with the New York State Division of Human Rights. Despite her efforts to bring the issue to the network’s attention, McHenry says in her lawsuit that it was not resolved.
In her suit, McHenry says Murdoch’s inappropriate behavior began shortly after their first meeting in August 2018 at a dinner hosted by the network. McHenry and Murdoch were slated to cohostwhich would launch in November 2018. In October 2018, according to the suit, Murdoch began sending McHenry sexually charged text messages. “I love pony tails and braids you look amazing and itʼs a real turn on not that you care but I love it,” one read, according to the lawsuit. Another read, “I’ll show you what it mean to be bad Britt Mc Henry”//Dick pic coming in 5 sec!!!!” Murdoch allegedly sent the following messages over the course of two months: “I love your legs”//“Fuck them your beautiful I love that picture”//“Is it creepy how I look at you ???”//“FYI you’ll need those legs to escape from me in Montana”//“I please especially on your knees hotness”//“I love the fact your always working if we ever had sex I feel like after an orgazzum you say speaking of feeling good did see the story on the puppy rescue we should do a segment on it hand me my phone.” McHenry alleges she did not want to anger Murdoch by rejecting him, so she tried to deflect his texts by responding with nonsexual comments. In addition to the text messages, Murdoch allegedly made inappropriate comments to McHenry while in the workplace and grabbed her in a forceful manner. In January 2019, McHenry says she told her supervisor,executive producer Jennifer Rauchet, about the text messages. McHenry says she believes Rauchet ignored her complaints about Murdoch and did not alert human resources. A source with knowledge of the situation told me that Murdoch’s behavior was “referred to as ‘that’s just how he is,’” and that he was characterized at the network as “difficult.” The source added, “Multiple people witnessed him curse at McHenry on set. He was never punished for that either. He was never suspended for anything, to my knowledge.”Murdoch’s alleged behavior continued. According to the suit, on or around April 12, 2019, McHenry’s agent emailed John Finley, the executive vice president of development, to tell him about McHenry’s “intolerable work environment” as well as Rauchet’s response to her complaints. The following week, McHenry says she was contacted by Monica Mekeel, a Fox Human Resources senior vice president, who asked McHenry for every text message exchange with Murdoch. According to the suit, Mekeel essentially asked McHenry what she had done to provoke Murdoch’s advances. and given his own program, which the lawsuit claims was aggressively marketed by Fox and was, in essence, a promotion. McHenry’s internal complaint was closed by Fox after the network told her Murdoch’s conduct “did not constitute sexual harassment” because Murdoch had “no clear intent to have sex with her,” per the suit. For her part, McHenry was required to enroll in a sexual harassment course. McHenry persisted, demanding an outside investigation. According to the suit, in September 2019, following several requests, Fox News hired an outside investigator, who concluded that McHenry had not been sexually harassed. A copy of the investigator’s report was not provided to McHenry or her law firm. A source with knowledge of the situation said that, over the course of an interview with McHenry, outside investigators commented on “how pretty Britt was” and questioned “how she may have provoked” Murdoch. In October 2019, according to the lawsuit, Fox News counsel sent McHenry’s lawyers text messages ostensibly between McHenry and Murdoch that it had obtained during the outside investigation. “The two-page screenshot contains two photos claiming to be from Ms. McHenry to Mr. Murdoch with her cleavage and near bare breast shown,” the suit reads. “These photos and text messages are fraudulent, doctored, and not of Ms. McHenry.” According to the suit, McHenry offered for her phone to be forensically examined, provided Murdoch did the same. To date, the suit alleges, Murdoch “has refused to submit to a forensic examination of his phone.” The suit claims Murdoch showed the doctored texts to others at Fox, “irreparably harming” McHenry’s reputation. Murdoch’s behavior, McHenry told me in a phone conversation with her attorney, had “been building for a while. It really had turned a job I loved into a dreaded experience.” When she spoke to Rauchet, she said she was not told to contact human resources. “I have tried repeatedly, and so has Lisa, to sort this out, to comply with Fox,” McHenry said. “I endured not one, but two investigations when it was glaringly obvious [that] the first one was woefully inadequate. I think any woman can relate to feeling violated and upset that images of other women’s near-nude bodies are being represented as their own.” And yet “[Fox is] going to publicly announce that their investigation was thorough, and that they handled everything properly.” sued then chairman Roger Ailes for sexual harassment, and afterwas reported to have paid women millions in settlements, was profound on its surface—copresident
