The Cumberland County crash, which happened this July, killed three people after the driver of the tractor-trailer lost control and swerved into oncoming traffic.

Credit: Jimmie Brownignored drive-time regulations and had been driving for 36 of the last 72 hours when the crash took place, according to a civil lawsuit filed against the driver and the trucking/shipping companies that employed him.
According to federal regulations, within a 14-hour on-duty window, commercial drivers can work a maximum of 11 hours after 10 consecutive hours off-duty. Drivers are also required to take a 30-minute break after eight hours of driving and cannot exceed 60 hours on duty over a seven-day period or 70 hours in an eight-day period.
Melake stopped driving at 11:56 p.m. on July 13 but picked up his next load at 4:50 a.m. July 14 and was driving to New Jersey when he caused the crash in Cumberland County, according to the lawsuit. The lawsuit also said Flock Freight, the shipping company that hired 4G Express, was aware or should have been aware of 4G Express’ “unsafe history in performing services as a motor carrier,” citing a vehicle-out-of-service percentage more than twice the national average, a driver-out-of-service percentage more than three times the national average and several safety violations in the last two years.
