They argue that the ERA has met all necessary requirements, citing Virginia's ratification as the 38th state and recognition from the American Bar Association. They call on Congress to officially affirm the ERA as the 28th Amendment.

“The ERA would etch equal rights into the Constitution—to protect and expand our opportunities, choices and rights,” said Carolyn Maloney, president of New York State NOW and former member of Congress. Smeal and Maloney are ERA leaders who have worked for decades for the ratification, starting in the 1970’s when it passed Congress.
