Blankenship, wearing dark clothing, came out of the home at 8:09 p.m. and was taken into custody, according to the review. Blankenship told investigators that he had used the .380 handgun and that he was the only one who fired at officers. “Based on my review of all the evidence in this case, I find no evidence establishing Officer Smith committed a crime when he fired his rifle,” according to the review, signed by Vicki Klingensmith, senior chief deputy district attorney, on Jan. 12, and addressed to Englewood Police Department Chief Sam Watson.
