The owner of an E-Z Mart in Garden Ridge where a store clerk was killed in 2020 has given up its fight to set aside a multimillion-dollar award handed down by an arbitrator who found its negligence was a direct cause of the worker’s death. GPM Investments LLC, which does business as E-Z Mart , and Harriet Louise Rehman , on behalf of the estate of her late sister Pollyanna “Pam” Smotherman, notified a federal court in Dallas last week they had agreed to settle their dispute.
Convenience store chain wants court to set aside $4.5M award in San Antonio-area clerk’s slaying Smotherman’s mother, Virginia Smotherman, filed a lawsuit in 2022 in Harris County District Court accusing GPM of negligence and gross negligence and wrongful death in the litigation with GPM. The case was dismissed after GPM sought to compel arbitration. Virginia Smotherman died Sept. 4, 2023. Her daughter, Rehman, stepped in as representative for both estates.
