The Department of Homeland Security is using the case of a suspected illegal immigrant charged with murdering a Utah veteran to criticize sanctuary policies and push for tougher immigration measures.
The U.S. Department of Homeland Security ( DHS) is leveraging the tragic death of James Randell Witten, a 71-year-old retired Air Force and Army veteran, to advocate for stricter immigration enforcement policies, particularly targeting individuals in the country illegally who have been accused or convicted of crimes.
Witten was shot and killed outside his home in West Point, Utah, on May 30. The primary suspect, Axel Eduardo Chavez Marroquin, a 24-year-old immigrant from El Salvador, is charged with murder. According to DHS, Chavez entered the United States illegally in California in 2021. The agency asserts that Chavez had two prior arrests for domestic violence in California-one resulting in a conviction in 2024 in Santa Ana and another arrest in 2025 in Laguna Niguel.
In both instances, Immigration and Customs Enforcement (ICE) issued detainers, requesting notification before his release, but local authorities in California released him, which DHS attributes to sanctuary policies. Following his second release, Chavez allegedly traveled to Utah where the fatal encounter with Witten occurred. DHS Assistant Secretary Lauren Bis issued a statement condemning California's sanctuary policies, stating, "This monster is charged with murdering a 71-year-old Army and Air Force veteran in Utah.

" She added, "This illegal alien should've never been allowed on our streets, and James Witten should still be alive today. " The DHS also criticized the previous Biden administration for releasing Chavez into the country while highlighting the Trump administration's focus on cracking down on illegal immigration.
The agency confirmed it had lodged a detainer for Chavez with the Davis County Sheriff's Office in Utah, which acknowledged receipt and indicated he will remain in custody while his criminal case proceeds. Another individual, Aroldo, was mentioned in connection with the case, but DHS's statement did not address his status, and authorities have not detailed his alleged involvement. The incident has reignited debate over sanctuary cities and the cooperation between local law enforcement and federal immigration authorities.
DHS argues that non-cooperation endangers public safety, using this case as a prime example. Meanwhile, Chavez remains held without bail in the Davis County Jail on first-degree murder and other charges. The DHS is urging Utah officials to work with ICE to ensure Chavez's removal from the United States after his criminal proceedings.
The family of James Witten has been left to mourn the loss of a veteran, and the case continues to unfold with authorities still investigating the motive and the full extent of Aroldo's role.
