Barranco’s deportation case had been dismissed by a judge on Jan. 28. Soon after, DHS officials said they planned to appeal the decision, which they did, at the last moment possible, said Barranco’s attorney, Lisa Ramirez.The timeline of Barranco’s case is now unclear, with appeals lasting years in Ramirez’s experience. The Board of Immigration Appeals will review the appeal.by immigration officials in June 2025. He was detained by agents and was hit in the head several times, captured on video that was shared to social media. Legally, Barranco cannot be removed from the United States until there is a decision on the appeal. While the appeal is underway and his case remains in the court system, Barranco’s parole in place and family based petition for residency, methods to seek legal permanent residency, are in limbo. The government argued that Barranco should have applied for parole in place through ICE rather than United States Citizenship and Immigration Services, but there is no process in place to pursue parole in place through ICE, Ramirez said.When his petition for legal status through a family sponsor is approved through United States Citizenship and Immigration Services, a process Ramirez said is now taking on average nearly three years. The appeal process could last just as long, she said. “We will appeal this lawless ruling. This activist judge’s ruling does not change the facts that Narciso Barranco is an illegal alien,” a DHS spokesperson said.
