Georgia’s Democratic Party is suing to block two recent rules adopted by the State Election Board. The lawsuit argues the rules could be used by county officials to refuse to certify an election, potentially causing delays in finalizing the state’s results. Democrats say the rules violate a state law that makes certification a mandatory duty.
U.S. Rep Lucy McBath speaks at a news conference criticizing the State Election Board on Monday, Aug. 26, 2024, at the Georgia Capitol in Atlanta. Dr. Janice Johnston, a member of the Georgia State Election Board, speaks during a meeting at the State Capitol in Atlanta, Tuesday, Aug. 6, 2024. Janelle King, a member of the State Election Board, takes questions from the media during a brief recess during a meeting at the Capitol in Atlanta, Tuesday, Aug. 6, 2024.
The lawsuit says the rules invite post-election chaos, that the board is defying state law that says county officials “shall certify” results, and that more than a century of court precedent in Georgia finds county officials have no wiggle room.US agency to reexamine permit for Hyundai’s $7.
That, plus McKoon praising the takeover of the board and later emailing proposed rules to board members, has led Democrats to allege a once sleepy board is now a direct tool of Trump. Alleged fraud or misconduct should be handled by the courts, not by county officials as they tally results, the suit argues, citing more than a century of Georgia court rulings.
