Both defense teams filed motions to have the State Attorney's Office 4th Judicial Circuit removed from the case over alleged violations in attorney-client privilege.

JACKSONVILLE, Fla. — It is an issue that has been debated since November in a high-profile murder trial in Jacksonville.ruling on whether or not the State Attorney's Office Fourth Judicial Circuit would remain on the first-degree murder trial of Mario Fernandez and Shanna GardnerGardner and her second husband, Fernandez, are charged in what investigators say was a"murder-for-hire" plot to kill Gardner's ex-husband, Jared Bridegan in February 2022.

The ruling did not come May 2 because the lead prosecutor in the case was called back to the stand to testify about an email she sent that the defense said contained privileged documents. The SAO has said the documents are not privileged, which is another issue the judge will have to decide.
