Daniel Perry, a former Army sergeant, has been sentenced to 25 years in prison for the 2020 murder of 28-year-old Black Lives Matter protester Garrett Foster.

PUBLISHED 10:11 AM CDT May 10, 2023AUSTIN, Texas — Daniel Perry, a former Army sergeant, on Wednesday was sentenced to 25 years for the 2020 murder of 28-year-old Black Lives Matter protester Garrett Foster.

Foster was legally carrying an AK-47 rifle through downtown Austin during a summer of nationwide unrest over police killings and racial injustice when he was shot and killed by Perry Perry’s attorneys will appeal his conviction, and there is the possibility of him being pardoned. The day after Perry’s April 7 conviction, Texas Gov. Greg Abbot tweeted, “I am working as swiftly as Texas law allows regarding the pardon of Sgt. Perry.”

Abbott doesn't have the power to directly grant Perry a pardon. Instead, he made a request to the Texas Board of Pardons and Paroles to review Perry's case and decide whether he should be granted a pardon., the governor is authorized to grant clemency if the board recommends it, but the governor can also make a request for that recommendation to be issued. Abbott appoints the members of the board.

The governor has not said publicly how he came to his conclusion. It is not clear when the parole board will reach a decision on Perry’s case.
