The U.S. government filed a lawsuit against CVS Pharmacy, alleging that the company filled prescriptions for controlled substances illegally and sought reimbursement for them from federal health programs.
CVS Pharmacy Inc. and various subsidiaries are accused of filling 'unlawful' prescriptions in violation of the federal Controlled Substances Act, according to a unsealed civil complaint. The complaint also alleges that CVS sought reimbursement from federal health care programs for these prescriptions, violating the False Claims Act .
The lawsuit claims CVS ignored substantial evidence from multiple sources, including its own pharmacists and internal data, indicating that its stores were dispensing problematic prescriptions. Among the unlawful prescriptions filled from October 17, 2013, to the present, prosecutors cite dangerous and excessive quantities of opioids, early fills of opioids, and 'trinity' prescriptions — a dangerous combination of an opioid, a benzodiazepine, and a muscle relaxant. CVS is also accused of filling large quantities of prescriptions for controlled substances written by prescribers it knew to be engaged in 'pill mill practices.' A representative of CVS stated the company has cooperated with the DOJ’s investigation for over four years and strongly disagrees with the allegations and what it called the 'false narrative' within the complaint
