A court has ruled that viewers could reasonably believe Netflix’s ‘The Crown’ portrays actress Fiona Harvey’s story as fact, despite the show’s disclaimer stating it is a “true story.” This ruling allows most of Harvey’s lawsuit against the show to proceed to trial.

Fiona Harvey wins a ruling that viewers could understand the series to be an entirely “ true story ” that hurts her reputationEscher Walcott is a Writer/Reporter at PEOPLE, covering stories in Entertainment , Style, Human Interest. She joins having written for several popular news publications, including Glamour, Refinery29, NYLON and Evening Standard, discussing the latest fashion trends, pop culture news, and pressing social matters.

Harvey alleges in the lawsuit that the portrayal of obsessive stalker Martha on the show is defamatory in relation to her encounters with Gadd, 35. to stay up-to-date on the best of what PEOPLE has to offer, from celebrity news to compelling human interest stories., Gadd plays a version of himself named Donny Dunn. Though he says he changed some events “slightly to create dramatic climaxes,” he told “It’s very emotionally true, obviously: I was severely stalked and severely abused,” he said.

The judge, however, disagreed and stated that the events portrayed “would be interpreted as assertions of fact.” Gadd alleged in his court filing that Harvey touched him in “sexual” ways that were unwanted and claimed that she got hold of his personal information and contacted him “relentlessly,” sending him “thousands” of emails, voicemails and handwritten letters, including “sexually explicit, violent, and derogatory content, hateful speech, and threats.”
