Google, like all responsible service providers across the tech industry, takes the protection of children very seriously indeed. It uses “proprietary technology to deter, detect, remove and report offences,” including the identification of child sexual abuse material in Gmail email messages. When you sign up to use Gmail, you agree to Google’s terms and conditions that allow for such searches to happen. Now, a U.S.

The detected CSAM hash had been passed to the National Center for Missing and Exploited Children and then to law enforcement to investigate and potentially prosecute. Law enforcement, however, was found to have made a visual examination of the child abuse image rather than just the hash itself.

The good news is that the conviction stands as a good faith exception applied to the search on this occasion. The better news is that it sends a message to law enforcement not overstep the mark, and apply the correct search warrant procedure, when it comes to material found in Gmail. We all want to see such perpetrators brought to justice, and procedural errors that might prevent that from happening must be mitigated.
