The Court of Appeal has ruled that four Victoria Police officers and barrister-turned-informer Nicola Gobbo engaged in a conspiracy to imprison drug baron Tony Mokbel. Mokbel is currently serving a 26-year sentence for drug trafficking and claims Gobbo, his former lawyer, shared confidential information with police.

Four members of Victoria Police conspired with barrister-turned-informer Nicola Gobbo to try and put drug baron Tony Mokbel in prison, the Court of Appeal has found. Mokbel is midway through a 26-year sentence, and claims Gobbo, who was his lawyer, passed on legally-privileged material without his knowledge.

Victoria Police officers and barrister-turned-informer Nicola Gobbo formed a 'joint criminal enterprise' in a bid to put notorious drug baron Tony Mokbel behind bars two decades ago, a court has found. The findings were announced in the Court of Appeal on Monday, as part of the preliminary stages of Mokbel's appeal against serious drugs charges. Criticism was also levelled at Victoria's former top cop Simon Overland and one-time director of public prosecutions John Champion, who is now a serving Supreme Court judge. Mokbel is currently in prison, midway through a 26-year sentence for trafficking MDMA and methamphetamines. He is appealing and argues his then-lawyer, Ms Gobbo, passed on legally-privileged material to police without his knowledge, in a move that tainted his conviction. Earlier this year, Justice Elizabeth Fullerton was tasked with delving into the history of the Mokbel case and examined the actions of Victoria Police, prosecutors and Ms Gobbo at the time.On Monday, she said she was 'satisfied that the elements of a joint criminal enterprise to attempt to pervert the course of justice were made out'. 'Four members of Victoria Police participated with Ms Gobbo in that agreement to achieve that unlawful objective,' she said. Justice Fullerton said her judgement was made on the balance of probabilities, not to the criminal standard that requires a finding beyond reasonable doubt.Mokbel smiled and waved to his family in court as the judge delivered her decision, before he was walked out flanked by custody officer
