A federal court has issued a temporary restraining order preventing the Trump administration from sending three Venezuelan immigrants held in New Mexico to Guantánamo Bay for detention. This action comes amidst growing controversy over the administration's use of Guantánamo to hold undocumented immigrants.
A federal court issued a temporary restraining order on Sunday, halting the Trump administration's plan to send three Venezuelan immigrants held in New Mexico to the Guantánamo Bay, Cuba detention camp. This action is part of the president's broader efforts to remove undocumented immigrants from the United States.
Lawyers representing the three men argued in a legal filing that their clients fit the profile targeted by the administration for detention in Guantánamo: Venezuelan men detained in the El Paso area on (alleged) charges of connections with the Tren de Aragua gang. They requested a temporary restraining order from the U.S. District Court in New Mexico to prevent their transfer to the U.S. military base. The lawyers emphasized that 'the mere uncertainty the government has created surrounding the availability of legal process and counsel access is sufficient to authorize the modest injunction.'Judge Kenneth J. Gonzales granted the temporary restraining order, according to attorney Jessica Vosburgh, who represents the three men. Vosburgh stated, 'It's short term. This will get revisited and further fleshed out in the weeks to come.' This legal action stems from a lawsuit filed on behalf of the three men by the Center for Constitutional Rights, the American Civil Liberties Union of New Mexico, and Las Americas Immigrant Advisory Center. This development comes amidst a controversy surrounding the Trump administration's use of Guantánamo Bay to detain undocumented immigrants. Last week, Homeland Security Secretary Kristi Noem and White House press secretary Karoline Leavitt confirmed that flights carrying detained immigrants had been sent to Guantánamo. Immigrant rights groups have publicly criticized the administration's decision, demanding access to those now held at the U.S. naval station and arguing that the base should not function as a 'legal black hole.' Guantánamo has faced international condemnation for its alleged inhumane treatment and torture of detainees, including the use of controversial interrogation tactics. The immigrants are being held in a separate section of the Guantánamo detention camp, which was established following the 9/11 attacks to hold detainees. The Guantánamo Bay detention camp has been a source of significant global concern due to allegations of human rights violations. Trump has pledged to expand the facility to accommodate up to 30,000 'criminal illegal aliens.' Leavitt revealed on Wednesday that over 8,000 immigrants had been apprehended since January 20 as part of Trump's initiative to detain and deport undocumented immigrants within the country, although hundreds of those arrested have subsequently been released back into the U.S.
