Senator John Cornyn's campaign released a new political ad attacking opponent Ken Paxton, using an AI-generated parody of 'Love Shack' to highlight Paxton's scandals. The ad, referencing Paxton's alleged affairs and the use of an alias, underscores the growing use of AI in political advertising. The ad has raised questions about the legal and ethical implications of using AI in campaign ads.

Senator John Cornyn 's campaign launched a new political ad vertisement on Tuesday, targeting his primary runoff opponent, Ken Paxton . The ad takes the form of a parody, mimicking the iconic song 'Love Shack' by The B-52s. The advertisement features an AI-generated figure resembling Paxton. This AI-Paxton is depicted in a vehicle alongside two women whose faces are obscured by black squares, labeled 'Mistress #1' and 'Mistress #2'.

The campaign intends the parody to remind Texans of the various scandals surrounding Paxton, including the alleged use of the alias 'Dave P.' to arrange Uber rides for meetings with mistresses, and the two affairs that contributed to his wife's decision to file for divorce on 'biblical grounds'. Cornyn's campaign issued a statement asserting, 'On May 26th, Texans will order ‘Dave P.’ a one-way ride to his ‘Love Shack’ – far away from the nation’s capital.'\The lyrics of the parody song directly reference incidents that came to light during Paxton's 2023 impeachment trial. The song goes, 'He’s heading down the corrupt highway, looking for his lying getaway. Got himself a ride, it’s an Uber tonight, heading on down to the Love Shack.' Records revealed an Uber account created by Austin real estate developer Nate Paul under the name 'Dave P.', which Paxton purportedly utilized to travel to Paul's residence and the apartment of a woman with whom the Attorney General was allegedly involved in an extramarital affair. Furthermore, Paxton's wife, Angela, filed for divorce last year, citing adultery as the primary reason and using the phrase 'biblical grounds' in the divorce petition. Paxton's campaign has so far refrained from offering any comment on the newly released advertisement. The advertisement's use of AI-generated content also brings to light the existing legal framework surrounding the use of artificial intelligence in political campaigns. While Texas has enacted a law prohibiting the use of deepfakes in campaign advertisements, this law applies only to state-level races and does not extend to federal races. Consequently, the use of AI in Cornyn's ad is permissible under current regulations.\This isn't the first instance of AI being utilized in this particular race. Earlier in the year, Paxton's campaign released an advertisement that featured an AI-generated depiction of Cornyn dancing with Representative Jasmine Crockett. The National Republican Senatorial Committee has also weighed in on this trend, releasing an AI video showcasing Democratic Senate nominee James Talarico reading old tweets. Currently, there are no federal regulations governing the employment of AI-generated content in political advertising. Legal experts, such as University of Houston Law Professor Seth Chandler, believe that the process of implementing effective regulations will be lengthy. Chandler commented, 'I think it will take time for federal or state regulators to even attempt to come up with sensible regulations. And this may be an area in which the cure is worse than the disease. That is, that when you start saying that, well, because they used AI, we can have additional censoring of the message, that starts to get very, very dangerous.' The evolving landscape of AI in politics presents challenges in terms of ethical considerations, potential misinformation, and the need for legal and regulatory frameworks that balance freedom of speech with the necessity to safeguard against harmful uses of technology during political campaigns
