Pollyanna “Pam” Smotherman, 40, was killed in 2020 at the E-Z Mart at 19501 FM 3009 in Garden Ridge. Her killer has never been apprehended.

After the 2020 slaying of E-Z Mart gas station clerk Pollyanna “Pam” Smotherman, her mother filed a wrongful death lawsuit against the store’s operator, alleging its negligence directly caused Smotherman’s death. The case never got to trial because the company was able to have it moved to arbitration. Now, after an arbitrator in May awarded Smotherman’s estate $4.45 million, GPM Investments LLC, which does business as E-Z Mart , wants a court to toss the award.

The company says the arbitrator showed “evident partiality” and exceeded his authority. Smotherman’s sister wants another court to confirm the award. Her mother died after the case began, so the sister, Harriet Louise Rehman, is representing the women’s estates in the case.
