On Thursday, Texas Attorney General Ken Paxton issued a decisive opinion, Opinion No. KP-0510, confirming that county constables in Texas do not have the legal authority to use photographic or automated traffic-enforcement systems to issue speeding citations by mail.

SAN ANTONIO - Bexar County Constables will no longer be able to use a portable LIDAR camera system to issue speeding tickets. This opinion aligns with the stance of Bexar County District Attorney Joe Gonzales, who has consistently advised local law enforcement that such automated citation programs are not authorized under Texas law and pose significant due process concerns. The Attorney General's opinion underscores that traffic enforcement must adhere to the Texas Constitution, the Transportation Code, and the Code of Criminal Procedure.It clarifies that traffic citations can only be issued through lawful traffic stops and authorized enforcement procedures, eliminating any ambiguity regarding the legality of automated systems for counties or constables.
