Rep. Eli Crane (R-AZ) is set to introduce articles of impeachment against a federal judge who is attempting to impede the Department of Government Efficiency (DOGE) from accessing Treasury Department payment systems. Crane's move comes in response to a temporary restraining order issued by Southern District of New York Judge Paul Engelmayer, an Obama appointee, which prevents DOGE from accessing the payment systems.
Engelmayer's order stemmed from a lawsuit filed by 19 left-leaning state attorneys general who argued that DOGE lacked the authority to access these systems. The attorneys general contended that allowing DOGE access would result in irreparable harm to the states, as it risked disclosing sensitive and confidential information and making the affected systems more vulnerable to hacking. They also asserted a likelihood of success on the merits of their claims. As a result, Engelmayer's order restricts DOGE's access until February 14th, permitting only BFS civil servants with proper security clearance and a need to access the payment systems for their duties. All other political appointees, special government employees, and government employees outside the Treasury are prohibited from accessing these systems. Crane believes Engelmayer's actions constitute judicial overreach and a threat to democracy. He argues that judges should not inject their policy preferences over those of elected officials. Crane's impeachment move follows a broader sentiment expressed by former President Trump, who suggested that Congress should consider taking action against activist federal judges who are obstructing the administration's efforts to combat corruption.
