Motsoeneng appealed the SCA's dismissal of his appeal against initial Gauteng High Court decision
Motsoeneng sought to appeal the Supreme Court of Appeal’s dismissal of his appeal against the initial Gauteng High Court in Johannesburg’s decision that invalidated the payment and subsequently ordered Motsoeneng to repay the money.
The apex court in an order on Wednesday concluded that the application for leave to appeal does not engage its jurisdiction. The Special Investigating Unit has since welcomed the order which paves the way for the agency to recover the remainder of the “success fee,” with interest. SIU Spokesperson Kaizer Kganyago elaborates, “In August, the SABC Board decided to pay Motsoeneng a success fee for his role in securing the Multichoice deal. The High Court ruled that Motsoeneng must repay the R11.5 million plus interest bringing the total liability to approximately R18 million. The SIU has already recovered R6.4 million from his pension benefit and sees this as a positive step in clearing the way to pursue the outstanding amount from Mr Motsoeneng.
