Are we to prioritize a nonviable embryo or fetus over the woman? Politicians did not ask...

Amanda Zurawski presented to her physician or her local Austin hospital at 18 weeks gestation with her cervix dilated; it was an “incompetent cervix.” The fetus had cardiac motion. This is not a rare event. In that moment, the physicians knew, without a doubt, several things.

The standard of care in this scenario, whether there is cardiac motion in the fetus, is to evacuate the uterine contents to protect the woman’s life. In obstetrics, we never sacrifice the woman’s health for the fetus. Zurawski was later admitted to the hospital when the fetus no longer had cardiac activity and she was critically ill with sepsis, being admitted to the ICU after the procedure. We have seen deaths from this situation in countries like Ireland and Poland, where their abortion laws have been similar to those in Texas.

Texas law is that the physician could only evacuate the woman’s uterus to save her life or prevent “substantial impairment of major bodily function.” In that moment, she was not sick, and doctors were reluctant to intervene. The law is absurdly murky.
