CITING lack of jurisdiction, the Commission on Elections (Comelec) has reversed its ruling that disqualified Cagayan Gov.
Manuel Mamba from the May 9, 2022 gubernatorial race he had won for violation of the the 45-day election ban on the disbursement of public funds.In an 18-page decision promulgated on March 6, the seven-man Commission En Banc set aside the decision of the Comelec Second Division, saying that that the petition filed by Ma. Zarah Rose De Guzman-Lara was filed after Mamba had been proclaimed as winner.'...
, which is after the proclamation of respondent,' it said.It added: 'Respondent was proclaimed by the Provincial Board of Canvassers on May 11, 2022 at 1:39:54 a.m.. This proclamation effectively divested the Commission of any authority to hear and decide the disqualification to take cognizance of the subject petition as it was filed after respondent's proclamation.
