Jack Phillips of Masterpiece Cakeshop cited his religious beliefs as reason not to bake the cake for Autumn Scardina.
The Colorado Supreme Court on Tuesday dismissed a case surrounding a transgender woman’s claim a baker discriminated against her by refusing to design a cake in celebration of her gender transition.
Scardina accused Phillips of discriminating against her by refusing to make a pink cake with blue frosting, according to the state Supreme Court’s majority opinion. Masterpiece Cakeshop allegedly told Scardina it could not bake the cake because of the “message” behind it, and Phillips later said in a federal court the dessert would have opposed his religious beliefs.
The state Supreme Court said Scardina did not appeal a denial of a hearing on her claim by the Colorado Civil Rights Division, which enforces anti-discrimination laws, after she requested a judgement. That lack of an appeal, rather than the merits of her claim, provided reason for the dismissal, the justices said.
We cannot answer that question however, because of a threshold issue of administrative law and statutory interpretation: Could the district court properly consider the claims of discrimination presented here?” the justices continued. “In light of this dispute’s procedural journey, it could not.”
