Justice Thomas raised concerns about the court's associational standing doctrine in rejecting a challenge to a key abortion pill.
Clarence Thomas wants the U.S. Supreme Court to reconsider a 47-year-old ruling.The Supreme Court on Thursday handed down their decision in a key reproductive rights case, unanimously rejecting efforts to restrict access to mifepristone, a pill that is used in more than 60 percent of abortions across the United States. Each of the court's justices agreed the plaintiff in the case lacked standing.
The court has also 'never attempted to reconcile' associational standing doctrine with 'the traditional understanding of judicial power,' he wrote.'Instead, the Court departed from that traditional understanding without explanation, seemingly by accident. To date, the Court has provided only practical reasons for its doctrine,' Thomas wrote.
