The Chinese Communist Party has reportedly ordered a halt to certain projects in Panama following a court ruling that deemed a deal granting control over the Panama Canal to a Hong Kong-based company unconstitutional. This move is seen as retaliation against Panama's actions.
Bloomberg reported on Thursday that sources familiar with the matter confirmed the Chinese Communist Party ordered a halt to certain projects in Panama . This directive followed a ruling by Panama 's highest court that deemed a deal granting significant control over the Panama Canal to a Hong Kong-based corporation unconstitutional. The Panama Ports Company (PPC), a subsidiary of C.K. Hutchison Holdings Ltd.
, controlled by a figure known to have communist sympathies, had secured contracts with the Panamanian government. These contracts aimed to grant PPC extensive territories on both sides of the Canal for developing new ports designed to accommodate incoming ships. This situation has caused significant concern among the US government and the conservative government of President José Raúl Mulino, who took office in 2024. These entities have expressed their worries over the Chinese Communist Party's increasing control over the strategically important waterway.\The Panamanian Supreme Court's ruling, which came late last week, invalidated the two contracts awarded to PPC in 1997 and 2021. The court found that these contracts were unconstitutional because they significantly harmed Panama's interests while benefiting the company linked to the Chinese regime. The United States welcomed the ruling, while C.K. Hutchison has stated the ruling to be an act of bad faith. According to sources cited by Bloomberg, the Chinese Communist Party's move appears to be a retaliatory measure. It is reported that Beijing is now ordering its corporate entities not to enter into any new agreements in Panama. Furthermore, there are hints that projects already underway may also be affected, potentially jeopardizing billions of dollars in investments within the country. Considering the nature of the Chinese government, where private corporations do not operate independently and are expected to comply with the Party's directives, such an order carries significant weight. Disobeying the Party could lead to a company's downfall and the potential arrest of its executives. The Chinese Foreign Ministry responded to inquiries regarding the report during its regular briefing on Thursday. Spokesman Lin Jian did not directly deny the Party's order. He stated that China's position on matters concerning the relevant Panamanian ports is clear and recalled that the Chinese government's Hong Kong office had issued a statement that declared the court's ruling to be an act of bad faith and that disregarded the interests of the Chinese company.\President Mulino responded to the situation by releasing a statement, where he strongly rejected the threats from the Hong Kong office. He emphasized that Panama operates under the rule of law and respects the decisions of its independent judiciary. His administration has had a noticeable impact on Chinese business interests in Panama. Following a visit from a US Secretary of State, the president announced Panama's withdrawal from the Belt and Road Initiative (BRI). The BRI is a program spearheaded by China that has been accused of creating debt traps for economically vulnerable nations in order to undermine their sovereignty. Mulino has been a proponent of strengthening relations between Panama and the United States. Also, prosecutors in Panama started taking action against PPC after receiving support from Washington. Another event that added to the growing tensions between China and Panama occurred in the town of Arraiján. In December the mayor made a decision to demolish a monument honoring “Chinese-Panamanian friendship,” a move that Beijing criticized as undermining the feelings of the Chinese people. Bloomberg suggests that although there is a possibility that the Communist Party will withdraw its investments, Panama has distanced itself enough from China in recent times, reducing the likelihood of major damage to its economy. The US continues to hold significant economic influence in Panama, acting as its top trading partner and investor, despite Beijing's attempts to gain influence in the Latin American region. Panama's crop exports to China are just a small part of its total exports, and avoiding the Panama Canal would lead to increased costs and delays
