COLUMBUS, Ohio - During the State Conference Committee to hash out a new budget, lawmakers included a change to the “Art Modell Law” that could create a clearer path for a Browns move to Brook Park. The proposed change was submitted around 1 a.
m. Wednesday, just hours before a final budget vote by the House and Senate on what budget to send to the Gov. DeWine for approval.“No owner of a professional sports team that uses a tax-supported facility for most of its home games and receives financial assistance from the state or a political subdivision thereof shall cease playing most of its home games at the facility and begin playing most of its home games elsewhere unless the owner either...” The new proposal would eliminate “elsewhere” and replace it with “outside the state”, meaning only a move outside Ohio would violate the Modell Law. If this passes, that means the Browns would officially not be in violation of the Modell Law, meaning there would be no legal issues for relocation to Brook Park., the Browns had argued in court that the Modell Law shouldn’t apply in this case due to the proximity of the move and the move occurring at the completion of the lease. The law, which went into effect in 1996 after the Browns moved to Baltimore, puts relocation restrictions on owners of professional sports teams that use a tax-supported stadium, like the Browns. “We are very troubled and angered by this late-night change, added without public scrutiny, regarding the Modell Law. We strongly oppose this legislative maneuver because Clevelanders have invested hundreds of millions in the lakefront stadium and surrounding infrastructure. This proposed change fails to protect communities like us when a team decides to leave.
