A unilateral decision taken by the Commission for Gender Equality chairperson Advocate Olave Nthabiseng Sepanya-Mogale to appeal a court ruling dismissing the suspension of a full-time commissioner is being questioned.
Former Commission for Gender Equality CEO Phelisa Nkomo has left without finishing her five-year term.
Botha was suspended on August 6 2021 after he had allegedly made remarks to a colleague about fellow commissioner Nomasonto Mazibuko’s albinism and had said that former chairperson Tamara Mathebula lacked backbone, during a break at the commission’s plenary session on July 30 2021.The court dismissed Botha’s suspension on February 15. However, the commission indicated in court papers on February 20 that it was seeking to appeal that order.
City Press has seen correspondence, dated Tuesday June 20, from Vilakazi that is addressed to Kganare.Vilakazi wrote that the power of attorney purportedly entered into with the commission to authorise Kganare’s firm to pursue its appeal of the court judgment was insufficient.
