In a Travis County courtroom on Wednesday, parents of some of the young girls who died in the catastrophic flooding at Camp Mystic last July listened in as the camp's attorneys argued for a motion to compel arbitration, which could move pending lawsuits to be resolved behind closed doors instead of in public trials.
"The idea that the outcome of it and the testimony of it would be cloaked in the secrecy of a hotel conference room in Kerrville, Texas. For nobody to know what happened, for nobody to get the testimony or the results. Nobody to learn from it, and nobody to know the outcome of--It is just beyond the pale of bad public policy," the Steward family's attorney Brad Beckworth told the court Wednesday.
The defense, however, filed a motion for arbitration in May. Wednesday's hearing centered on arguments for and against the motion. Camp Mystic attorney Joshua Fiveson cited agreements signed by campers' parents, which they argue support the motion for arbitration.
"Though I understand Mr. Beckworth has a job to do, this is complete theories and connecting dots that frankly do not exist. He's a wonderful storyteller, but I'm not. I just wanna talk about the law," Fiveson told the court following arguments from Beckworth. Judge Maya Guerra Gamble told the court she will work to evaluate the presented evidence and share a decision soon.
During Wednesday's hearing, plaintiffs also presented a series of motions for sanctions against the defense. They alleged alteration of evidence, dishonesty, and "bad faith conduct" from defense attorneys.following a court hearing. He also argued that the Eastland family, which operated the camp, failed to properly preserve evidence on site despite being aware of a criminal investigation.
