A California classroom aide is accused of slapping an 11-year-old student with special needs in the face, according to a lawsuit filed last week.

The student, who has an Individualized Education Plan , allegedly broke his pencil "out of frustration" after a disagreement. He then went to the front of the classroom to tape his pencil back together, but Bungatto "attempted to restrain" him, according to the lawsuit. No other employees in the classroom attempted to intervene, nor was the student given immediate medical attention, according to the lawsuit. The student's parents were also allegedly never notified of the incident, violating district policy.
