The two operators of the daycare center, Grei Mendez, 36, and Carlisto Acevedo Brito, 41, both have been indicted on federal charges of narcotics possession with intent to distribute resulting in death and conspiracy to distribute narcotics resulting in death.

Prosecutors in New York already had indicted Mendez and Acevedo Brito on charges of murder, manslaughter and assault in connection with last week’s death of Nicholas Dominici, 1,“Parents entrusted Grei Mendez with the care of their children,” U.S. Attorney Damian Williams for the Southern District of New York said in a statement.
On Friday, Sept. 15, four children became ill from exposure to fentanyl, authorities say. Before calling 911, Mendez called her husband, who came to the daycare and helped Mendez carry two full shopping bags out of the daycare through a back alleyway, prosecutors say. It was not specified what was in the shopping bags.
“Kilo presses” reportedly were found in the daycare, including in the closet of Acevedo Brito’s bedroom at the daycare center. The presses are used to break down drugs and combine them with fillers before being portioned for sale, prosecutors say.
