Advocates claim migrants are forced to discard vital belongings when processed by Border Patrol
Border Patrol’s resources and infrastructure might buckle under the increase in detainee numbers, which could result in overcrowding and longer detention times, according to the report. More than a million people have been expelled from the U.S. under Title 42 so far in fiscal year 2022, per CBP data. the administration’s efforts, leaving the policy in place indefinitely. In response to the report and its suggested recommendations, CBP noted that it has given guidance to the field for processing migrants and when Title 42 is rescinded, the report said.
The report found that Border Patrol faces challenges in administering post-apprehension outcomes consistently across sectors. Migrants who were not subject to Title 42 expulsions typically faced administrative and not criminal outcomes, mostly because of capacity limitations and constraints on how long the Border Patrol should detain apprehended migrants, the report said.
In the Border Patrol's Yuma Sector, holding facilities exceeded capacity by 529% in September 2021, according to the report. for the first time in one year, largely exceeding last year’s number of more than 1.7 million arrests, according to recently released CBP data. The Border Patrol generally processes and detains migrants short-term, typically not to exceed 72 hours, before transferring them to ICE Enforcement and Removal Operations, which is responsible for long-term detention of migrants.
