The way police described their encounter with Sylvester Taylor Gaulden, they had no choice but to use a baton and beanbag launcher to stop him from terrorizing a neighborhood.

An officer grabs a spit masked Sylvester Gaulden following a February 2020 encounter with San Jose Police where officers batoned Gaulden and fired a less-lethal 40 millimeter weapon at him.

Retired Boston police lieutenant Tom Nolan, who examined the footage, called it one of “repeated instances where police officers seem to be unaware there is video that is in direct contradiction with the ways they are narrating the incident in their reports.” Gaulden’s behavior on the evening of Feb. 13 certainly seemed as if it might lead to a bad end. Wrapped in a blanket, carrying what appeared to be a pillow, Gaulden was darting around the street near the corner of Joseph Lane and Tobias Drive and into the path of moving cars, callers told 911 operators, in behavior that appeared to stem from a mental health crisis.

In his report, Juric says Gaulden “started to charge me.” Adgar said Gaulden turned toward Juric after being struck with the baton, showing “multiple pre-assaultive behaviors.” Only then did he fire his beanbag launcher. The department’s standard post-incident assessment describes Gaulden’s behavior in even starker terms, using language drawn from SJPD’s force guidelines.

Case records say that the officers who responded had received crisis intervention training, without mentioning Juric and Adgar by name.Crime and Public Safety |“I would characterize this use of force as unwarranted and unnecessary. didn’t have time to comply, and then that officer hit him like it was batting practice,” Nolan said.
