Attorneys representing the State of Utah in a lawsuit filed by the parents of a three-year-old boy who was killed on May 2, 2022, filed a motion to dismiss the parents’ lawsuit on the grounds of governmental immunity.

Kent Cody Barlow is charged with the murders of Odin Ratliff and Hunter Jackson and is awaiting trial in September. Barlow was on parole at the time of the little boys’ deaths and was under the supervision of AP&P. Utah County prosecutors say Barlow was high on methamphetamine and was driving 123 miles per hour when he lost control of the wheel and crashed through several fences at Cedar Valley Stables, a horse boarding facility killing the children.

“While each of the Defendants raised governmental immunity as a basis to defend against the lawsuit, the BOPP was uniquely positioned to also raise discretionary and quasi-judicial immunity. In order to focus on our stronger claims against the other defendants we voluntarily dismissed the BOPP. This dismissal was without prejudice, which means the claims can be reasserted, if appropriate, as the case develops, and more information comes to light.
