A DOJ memo says state and local officials who do not align with President Trump's crackdown on immigration enforcement could face criminal penalties.
Democratic attorneys general from 11 states issued a statement Thursday vowing not to use their resources to enforce federal immigration laws despite increased pressure from the Trump administration.
“Federal law prohibits state and local actors from resisting, obstructing and otherwise failing to comply with lawful immigration-related commands and requests,” the memo reads. "The U.S. Attorney’s Offices and litigating components of the Department of Justice shall investigate incidents involving any such misconduct for potential prosecution."
"While the federal government may use its own resources for federal immigration enforcement, the court ruled in Printz v. United States that the federal government cannot ‘impress into its service—and at no cost to itself—the police officers of the 50 States,'" the statement reads. "This balance of power between the federal government and state governments is a touchstone of our American system of federalism.
