Penny was acquitted in the death of Jordan Neely, a homeless Black man, this week. Neely said he was "ready to die" when he entered the subway car and proceeded to threaten riders. Neely died after Penny used a chokehold on him while both were riding a New York City subway in 2023. “We need some Black vigilantes,” he said. “People want to jump up and choke us and kill us for being loud? How about we do the same when they attempt to oppress us?”“BLACK MAN!” he wrote in November. “YOU EITHER GONE ORGANIZE AND FIGHT WHATS COMING POLITICALLY OR LAY DOWN AND TAKE IT. WHAT YOU WONT DO IS WHINE ABOUT EVERYTHING LITTLE THING LIKE PUNKS!”
