A $4.5 million jury verdict against Birmingham Officer Aric Mitchell for excessive force in the 2019 shooting of Jamarcus Moore and injury of Samantha Hardin has led to a $750,000 settlement by the city. Despite the jury's finding, Judge Manasco granted Officer Mitchell qualified immunity, stating that the unconstitutionality of his actions was not clearly established at the time. This prompted the city council to unanimously approve the settlement to avoid further appeals.
The incident began with Moore, who had warrants out for his arrest, speeding away from a police officer during a car chase that spanned multiple cities. Body camera footage captured a 20-minute pursuit, during which reports indicated gunfire originating from Moore's vehicle, but no victims came forward. It was during the final moments of the chase that Officer Mitchell's patrol car collided with Moore's Camry. Within seconds, Mitchell exited his vehicle and fired four shots into the driver's side of the Camry, fatally striking Moore and injuring Hardin. A gun was later found on the Camry's floorboard, but Mitchell claimed Moore had reached for it. The city's settlement and the ongoing debate surrounding the incident raise questions about police accountability and the use of force. Johnathan Austin, the attorney representing Hardin and Moore's sister, stated, 'The important thing is that people have to be accountable. Our citizens have rights that must be protected. When those rights are violated, there are consequences.' The case will be dismissed upon the signing of a stipulation of dismissal by all parties involved.
