The proposal, known as the “Freedom of Association in Higher Education Act of 2025,” would amend the Higher Education Act of 1965. That original measure increased the amount of federal dollars given to universities for scholarships and financial aid. Fraternities and sororities under the new amendment would become defined as a “single-sex organization.” Those groups would be protected from “adverse action” by their campuses for “limiting membership only to individuals of one sex.”“I cannot imagine my college experience without my fraternity brothers,” Sen. Gallego wrote. “As a first-generation student in a completely new environment, having a strong community to lean on was essential. I’m proud to support this bill to protect students’ access to Greek life, since no student should be penalized for finding a home away from home.” The proposal follows frequent debates over the inclusion of transgender students in campus Greek life organizations. A judge ruled in 2023 a transgender University of Wyoming student could not legally have her Greek life membership voided on the basis of her gender identity.
