President Joe Biden, as he leaves the White House, is tightening asylum rules at the U.S.-Mexico border. He announced stricter rules Tuesday, finalizing restrictions put in place in May 2023 and June 2024. These new rules allow Border Patrol officers to decide on asylum cases during initial interviews. The Department of Homeland Security (DHS) argues this will 'enhance operational flexibility' and allow for quicker removals of those deemed ineligible for asylum.
The Biden administration initially criticized similar policies from the Trump era, saying they hindered efficient screenings and due process. However, high numbers of illegal border crossings led to the reimplementation of these restrictions in May 2023. A cap on daily crossings was introduced in June 2024, effectively halting all asylum case processing due to the high volume of immigrants at the border. This number was later reduced to 1,500 in September. Tuesday's final rule grants asylum officers the authority to decide on cases during an immigrant's first interview at the border, without legal representation for the applicant. Officers are expected to use discretion when applying these new rules
