In a filing with the New Orleans-based Fifth U.S. Circuit Court of Appeals, the Justice Department said a U.S. District Judge in Texas engaged in an “extraordinary and unprecedented” usurpation of the U.S. Food and Drug Administration’s authority by ruling that the pill shouldn’t have been approved.
