Ben Roberts-Smith's defamation case against Nine Entertainment was dismissed in June, with the publisher arguing they want the war veteran to pay for the entirety of the proceedings.
The case occupied 110 hearing days, which deprived other litigants of the resources of the court, he said, rejecting Mr Roberts-Smith's argument that he wasn't to blame for the case becoming "grossly prolonged".
He said in June 2019, Mr Roberts-Smith received a settlement offer which would have involved both sides paying their own costs, and by that point he was on notice that 13 witnesses would testify for the publisher's defence. At the time of publication, a confidential inquiry into the conduct of Australia's special forces in Afghanistan was already being conducted, he said.
