A court challenge to Eskom's grid access rules has been resolved with the relaxation of some requirements.
The settling of the dispute clears the way for Eskom to allocate grid to new projects. Renewable energy firm G7 has dropped its application for Eskom's grid access rules to be set aside after several changes to make the rules less onerous.
It had been feared that G7's court application would put the brakes on the allocation of grid access by Eskom to new projects, slowing down efforts to solve the energy crisis."The parties have agreed to an amicable resolution of the dispute. These engagements have resulted in an adjustment to the manner in which the Interim Grid Capacity Allocation Rules will be implemented and have provided much-needed clarity to the process.
Mark Tanton, the business lead for Necom on transmission, said that Eskom had engaged pragmatically with the industry"in the interests of the country" to find a solution that worked for both parties.The engagement was constructive and we got to an outcome that achieved the goals of both industry and Eskom late last month.
The requirements to have a water use licence in hand as well as civil aviation authority approval had been relaxed with applicants now needing only to show they had applied. Requirements around land use permission for the construction of projects were also relaxed. While applicants must have a lease with a landowner in place, they will no longer be disqualified from securing access if permission to sub-divide the land for non-agricultural use has not yet been secured.
