Luxembourg court sets aside Sulu heirs’ attachment order, says AzalinaOthmanS

In July 2022, two Luxembourg-based subsidiaries of Petronas were seized by court bailiffs as part of the heirs’ effort to claim the award. This came after the attachment order was given on July 11. In a statement, Azalina said Malaysia had immediately applied to the district court of Luxembourg to set aside the attachment order as part of interim relief.“The hearing took place on Dec 5 before the judge of the district court whereupon the attachment order was set aside.

“As a result, the Spanish court that initially appointed Stampa retroactively invalidated his appointment and nullified the alleged ‘preliminary award’ that he rendered in Madrid. “The French courts have stayed the enforcement of the purported ‘final award’ rendered by Stampa in France, pending the outcome of Malaysia’s action to set aside the ‘final award’.
