The 5th Circuit Court of Appeals rules that the floating barrier in the Rio Grande can stay in place.
"Our full court then granted rehearing en banc, vacated the panel opinion, and stayed the preliminary injunction pending appeal," the ruling explains.
Some of the judges write in the majority opinion that the US did not present enough evidence that the buoys were interrupting the river navigation or disrupting commercial traffic, and one judge wrote "a sovereign isn't a sovereign if it can't defend itself against invasion." Judges that disagreed with the ruling cite questions about if the Rio Grande is considered navigable and how the barrier will impact relations with Mexico.
This is not the end of the line for the buoys. This debate goes before Judge David Ezra in U.S. District Court on August 6.Governor Greg Abbott reacted to the ruling on X, saying: The Federal Court of Appeals for the Fifth Circuit just ruled that Texas can KEEP these buoys in the water securing our border.That is exactly where they will stay.
