In United States v. Medina-Cantu, the judges for the Fifth Circuit Court of Appeals concluded a section of federal code barring illegal immigrants from possessing or transporting firearms is constitutional. A district court denied that motion, holding that Bruen does not vacate a previous decision that people living in the U.S. illegally are excluded from the Second Amendment.
“We agree with the Government and hold that the Supreme Court’s decisions in Bruen and Rahimi did not unequivocally abrogate Portillo-Munoz's precedent,” Justices Carolyn King, James Ho and Kurt Engelhardt wrote in their unanimous opinion. “As such, under this circuit’s rule of orderliness, we are bound to follow Portillo-Munoz.”
