APD drafted a letter backing the pardon of Daniel Perry for Garrett Foster's murder, calling it self-defense, but didn't send it after talks with city leaders.
APD's interim chief drafted a letter supporting Daniel Perry 's pardon for the murder of Garrett Foster , arguing it was self-defense, but ultimately did not submit the letter after discussions with city leadership.
Interim Austin Police Chief Robin Henderson drafted a letter advocating for the pardon of Daniel Perry, who was convicted of murdering Black Lives Matter protestor Garrett Foster, but ultimately did not submit the letter after discussions with city leadership. Perry was convicted in April, 2023 of murdering Foster during a protest in downtown Austin in July 2020. Last week, Governor Greg Abbott pardoned Perry, with Travis County District Attorney José Garza, who accused Abbott of putting "politics over justice." In the unsent letter, which was addressed to the Texas Board of Pardons and Paroles, Henderson argued that Perry had acted in self-defense and should not have been charged with murder in the first place. "APD's investigation showed that Mr. Perry had the right to be on the public roadway, in the incorporated city limits of Austin, Travis County, Texas, that he did not provoke an armed encounter with Garrett Foster or engage in criminal activity other than a traffic violation, and that he acted justifiably in self-defense," Henderson wrote in the letter. However, after internal discussions, Henderson decided not to submit the letter. "Ultimately the drafted letter was not submitted," she said in a statement. "After discussions with City leadership, as is the standard in certain situations, I decided not to submit the letter."that the letter "shows disregard for due process & is a slap in the face to our justice system."Stay Connected
