Opponents of Biden's student-loan forgiveness are spotlighting another way to give borrowers debt relief
One of the challengers of President Joe Biden's student-loan forgiveness says the president can use a different law to get the relief to millions of borrowers. Biden's own team isn't so sure.that paused Biden's plan to cancel up to $20,000 in student debt for federal borrowers. The first case the court heard was brought by six Republican-led states who argued the relief would hurt their states' tax revenues.
"During the campaign, they were talking about doing broad-based debt relief," he said."It wasn't related to the pandemic. Senator Warren and others passed resolutions urging the Secretary to use the Higher Education Act to pass debt forgiveness. Scholars have written about this." She added at the end of the arguments that Biden's relief"is a pandemic-related program. It specifically focuses on the national emergency circumstances that have had profound financial effects on student-loan borrowers. And the Secretary acted to try to mitigate those financial harms from COVID."
So unlike the HEROES Act, the Higher Education Act would allow for the canceling of debts without the existence of an emergency like COVID-19. wrote a memo
