Andrew Scheer says the amendment would give people in Saskatchewan a fairer deal when it comes to existing railway exemptions.
This whole fracas started when CP claimed it did not have pay income, sales, fuel or capital taxes on its main line in Saskatchewan, and sued the government for $341 million in past payments. The lawsuit is currently before Regina Court of Queen’s Bench and the subject of a hearing that opened last month.
The Conservatives have not yet moved that proposed bill, but are asking the federal government to designate a day “where we can get this done,” said Scheer. It would still need to go to the Senate for a vote, so while it’s possible for it to pass through the House of Commons this week, he was unsure when the Senate would vote on it.
The Saskatchewan Act of 1905, which established the province, states the province must adhere to that clause in the CPR Act.Article content In legal proceedings, lawyers for CP have said that the agreement only pertained to the exemption from municipal taxation.
