Alabama has executed a man for the 2001 beating death of a woman as the state resumes lethal injections following a pause to review procedures

This undated photo provided by the Alabama Department of Corrections shows James Barber. A federal appeals court on Wednesday, July 19, 2023, refused to stop Barber's upcoming execution in Alabama, rejecting his argument that the state has a history of botched lethal injections. Barber, 64, is scheduled to be put to death Thursday evening, July 20, at a south Alabama prison, in the first execution scheduled in the state since Gov. Kay Ivey paused them in November for an internal review.

“Justice has been served. This morning, James Barber was put to death for the terrible crime he committed over two decades ago: the especially heinous, atrocious, and cruel murder of Dorothy Epps,” Attorney General Steve Marshall said in a statement. Barber was convicted and sentenced to death for the 2001 beating death of Epps. Prosecutors said Barber, a handyman, confessed to killing the 75-year-old with a claw hammer and fleeing with her purse. Jurors voted 11-1 to recommend a death sentence, which a judge imposed.“Tell the Epps' family I love them. I'm sorry for what happened," Barber said. “No words would fit how I feel.”

Barber said he wanted to tell the governor “and the people in this room that I forgive you for what you are about to do." Barber said he wanted to read a written statement but was not allowed to have the paper, since he was strapped to a gurney. In the statement, released later by his law firm, he wrote that “mere words could not express my sorrow at what had occurred at my hands.”in November. Alabama Gov. Kay Ivey announced a pause on executions to conduct an internal review of procedures.

The move came after the state halted two lethal injections because of difficulties inserting IVs into the condemned men’s veins.
